Yes. Restaurants must be trained and know the common food allergies and potential injuries of food allergies. They must also help consumers by identifying the ingredients in their food, confirming how the food is made, and warn what allergens/ cross-contamination may be present.

Can you sue a restaurant for a food allergy reaction?

Yes. A restaurant may have breached its duty of care towards a consumer if it has not properly warned or identified their allergen ingredients. However, the consumer also has a duty to tell the restaurant, before ordering their meal, about their food allergies to give the restaurant the opportunity to mitigate any damages.

What do I do if I have an allergic reaction?
